COUNTY COUNSELORCOUNTY COUNSELOR DEPARTMENTStarting Salary / Salary Range: $137,708.33 216,339.78 per year This is a full-time position which includes a full range of benefits including Paid Time Off, Extended Medical Leave, Holidays, Employee Health, Dental, Life, Disability, Retirement, and Tuition Assistance programs.This position is an appointment of the County Executive and requires advice and consent of the County Council. The position is not covered by the County Merit System. *The St. Charles County Charter requires that within one hundred twenty (120) days of appointment, each department head shall be a resident of St. Charles County. JOB DESCRIPTION: The Charter provides that all elected and appointed officials, as well as all appointed members of commissions and boards, and the Departments, divisions and employees of the county are represented by the County Counselor and the appointed deputy associate and assistant county counselors. This is reflective of the Charter of the County placing the duty of providing legal advice and representation for all aspects of the civil law business of the County with the County Counselor. By consolidating the authority for handling the civil law business of the county the charter recognizes that by state law St. Charles County and its elected and appointed officers and employees are representative of the single county government.The purpose of this position is to provide legal advice to county departments, board, commissions and elected and appointed officials at administrative hearings and before state and federal courts. Identifies potential legal liabilities. Supervises the work of the associate and assistant county counselors, paralegals and other paraprofessional staff of the office. Provides risk management advice and liability minimization training; and provides representation to employees sued for their work in the line of duty in accordance with the Countys ordinance of indemnification and representation of its employees. Fulfills the duties as set forth in the Charter of St. Charles County and laws of the State of Missouri. Enforces County ordinances, including oversight of the prosecution of County ordinances and traffic in the County ordinance court. Responds to questions of law for elected officials and Department Directors. Prepares legal documents, legal opinions and related memoranda regarding issues of concern to County officials and employees acting on behalf of the County.Consults regularly with the Director of Administration and keeps the Director informed of civil legal matters of the County.Provides litigation services on the County's behalf or in defense of the County, County officials and County employees in performance of their duties.Has charge of and conducts all of the civil law business of the County, its departments, divisions, offices, officers, boards and commissions.Institutes in the name of the County all civil suits and other proceedings at law or in equity to protect the rights and interests of the County.Enforces any and all rights, interest or claims against any and all persons, firms or corporation in whatever court or jurisdiction such action may be necessary.Negotiates contracts on behalf of, and in the best interest of the County.Oversees prosecution in the County municipal court. Furnishes legal advice and opinions to the County Council, the County Executive, County officials and to all County boards and commissions respecting County business.Represents the County in trial proceedings including litigation, pre-trial and post-trial motions and related activities. Prepares witnesses for hearings and trials.Directs and coordinates staff research assignments related to, litigation, County zoning, planning, law enforcement and general government duties.Supervises staff attorneys and paralegals and operates the office within the guidelines of the County personnel and purchasing policies.
